Clinton County Municipal Court dispositions

WILMINGTON — The following report is compiled using a disposition report provided by Clinton County Municipal Court. The information includes the defendant’s name, age, residence if listed, charge(s) disposed, fine, court costs assessed, jail sentence and any special conditions. Municipal Judge Mike Daugherty oversees the court, which administers the law in criminal misdemeanor cases.

The following pled guilty or were found guilty between April 24 and April 28:

• Zachary White, 23, of Middletown, child endangerment, O.V.I., driving under suspension-failure to appear/pay fine, sentenced to 360 days in jail, fined $2,200, assessed $375 court costs. ALS vacated. Additional charges of unauthorized use of a motor vehicle charge, driving under suspension, failure to control, and a seat belt violation were dismissed.

• Ernest Booher, Jr., 52, of Blanchester, obstructing official business, menacing, driving under suspension – sentenced to 120 days in jail (94 suspended), fined $1,000, assessed $250 court costs. Booher must have no alcohol or drugs of abuse, must have no contact with the victims, and report to probation to complete 64 hours of community service. Additional charges of disorderly conduct and false alarm were dismissed.

• Jeffrey Paas, 58, of Pickerington, reckless operation, sentenced to 30 days in jail (suspended), fined $500, assessed $125 court costs. The charge was amended from an O.V.I. charge. Paas must complete two years of non-reporting probation. ALS vacated. Paas has completed outpatient treatment. Additonal charges of O.V.I. and going 82 in a 70 mph speed zone were dismissed.

• Lila Kincaid, 20, of Midland, reckless operation, sentenced to 30 days in jail (suspended), fined $250, assessed $125 court costs. The charge was amended from an O.V.I. charge. Kincaid has completed three days of non-residential driver intervention. Jail time suspended on condition Kincaid commit no further offenses for two years and complete two years of non-reporting probation. ALS vacated. Additional charges of O.V.I. nad failure to control were dismissed.

• Marcus Brooks, 56, of Wilmington, reckless operation, sentenced to 30 days in jail (suspended), fined $250, assessed $125 court costs. The charge was amended from an O.V.I. charge. Brooks has completed a three-day non-residential driving intervention program. Jail time suspended on the condition that Brooks commit no further offenses for two years and also complete non-reporting probation. ALS vacated. A left to center violation was dismissed.

• Bryan Devault, 39, of Sabina, O.V.I., sentenced to 180 days in jail, operator’s license suspended from April 28, 2017 to April 28, 2018, fined $1,075, assessed $125 court costs. Jail time stayed to allow Devault to complete probation. Devault will complete SAQ and three-day driver intervention program if the compliant court will suspend $375 of fine. Driving privelages granted effectively on May 5, 2017. ALS vacated.

• James Stoops II, 24, of Wilmington, O.V.I., sentenced to 180 days in jail, operator’s license suspended from Jan. 2, 2017 to Jan. 2, 2018, fined $1,075, assessed $125 court costs. ALS vacated. Driving privileges effective immediately. An additional O.V.I/under the influence and a stop sign violation were dismissed.

• Matthew Beireis, 39, of Wilmington, menacing, sentenced to 30 days in jail (suspended), fined $250, assessed $125 court costs. The charge amended from an assault charge. Beireis must have no contact with the victim and must write a letter of apology to the victim. Beireis must serve two years of non-reporting probation and must complete eight hours of community service. An additional charge of aggravated menacing was dismissed.

• Michael Knuckles, 22, of Leesburg, theft, sentenced to 10 days in jail (suspended), fined $125, assessed $125 court costs. Knuckles must write a letter of apology to the victim, pay $28.88 in restitution, and must have no contact with the victim. Knuckles must complete no offenses for two years and take part in non-reporting probation. Knuckles is to report to probation on May 10.

• Zachary Hansford, 23, of Clarksville, driving under suspension, sentenced to 10 days in jail, fined $125, assessed $125 court costs. Hansford must complete eight hours of community service and report to probation on May 10.

• Robert Berwanger, 46, of Washington Court House, driving under suspension-financial, fined $125, assessed $125 court costs.

• Gregory McCoy, 30, of Cleveland Heights, unauthorized use of property, assessed $125 court costs. The charge was amended from an unauthorized use of a motor vehicle.

• Attica Scott, 45, of Louisville, going 93 in a 70 mph speed zone, fined $105, assessed $125 court costs. The case was waived by the defendant.

• Mario Magana, 18, of Louisville, going 91 in a 70 mph speed zone, fined $105, assessed $125 court costs. The case was waived by the defendant.

• Christopher Greene, 27, of Sabina, driving under suspension-failure to appear/pay fine, fined $50, assessed $125 court costs.

• Scott Woodgeard, 41, of Wilmington, driving under suspension, fined $125, assessed $125 court costs.

• Daniel Wallace, 33, of Dayton, driving under suspension-financial, sentenced to 10 days in jail (suspended), fined $125, assessed $125 court costs. Wallace must complete eight hours of community service and report to probation on May 10, 2017. Operator’s license to be destroyed.

• Corey Crothers, 25, of Peebles, driving under suspension-failure to appear/pay fine, fined $125, assessed $125 court costs. Additional charges of driving under suspension-reinstatement fee and no operator’s license were suspended.

• Joseph Bryant, 29, of Cuba, driving under suspension-financial, fined $125, assessed $125 court costs. An additional charge of driving under suspension-reinstatement fee was dismissed.

• Elizabeth Pasqualini, 31, of Wilmington, disorderly conduct, sentenced to three days in jail (suspended), fined $100, assessed $125 court costs. The charge was amended from a child endangerment charge. Pasqualini successfully completed an parental education class. An additional child endangerment charge was dismissed.

• Daniel Camp, 27, of Wilmington, theft, sentenced to 180 days in jail, assessed $125 court costs. Camp will pay costs only.

• Ryan Curren, 18, of Georgetown, disorderly conduct, fined $150, assessed $125 court costs. The charge was amended from a possession of marijuana charge. Additional charges of drug paraphernalia and no operator’s license were dismissed.

• Donald Moore III, 20, of Midland, disorderly conduct, fined $250, assessed $125 court costs. The charge was amended from an assault charge.

• Andrew Twining, 22, of Findlay, failure to comply, sentenced to 180 days in jail (suspended), fined $1,000, assessed $125 court costs. Twining must write a letter of apology to the Sabina PD officer, commit no offenses for two years and take part in non-reporting probation.

• Robert Allen II, 33, of Cleveland, going 92 in a 70 mph speed zone, fined $105, assessed $125 court costs. The case was waived by the defendant.

• Crystal Greene, 42, of Hamilton, driving under suspension-resinstatement fee, turn signal violation, fined $150, assessed $125 court costs. For the turn signal violation, Greene will pay fines only.

• Donald Davison, 41, of Xenia, D.U.I., sentenced to eleven days in jail, operator’s license suspended from April 27, 2017 to April 27, 2018, fined $1,000, assessed $125 court costs. Three driving under suspension charges were dismissed.

• Roy Taylor, 53, of Indianapolis, Ind., going 98 in a 70 mph speed zone, fined $105, assessed $125 court costs. The case was waived by the defendant.

• Sarah Stevenson, 37, credit misuse, sentenced to 180 days in jail, fined $1,000, assessed $125 court costs. The charge was amended from a receiving stolen property charge. Stevenson must write a letter of apology to the victims and have no contat with them.

• Hattie Stallworth, 55, of Simpsonville, S.C., going 91 in a 70 mph speed zone, fined $105, assessed $125 court costs. The case was waived by the defendant.
