Larry Casey rejects plea deal; accused rapist faces jury trial

WILMINGTON — An alleged rapist will stand trial in January.

Larry Casey, 47, of Gallipolis, a former police officer, is charged with five counts rape in the first degree, four counts sexual battery in the second degree, one count unlawful sexual conduct with a minor in the second degree, one count receiving stolen property in the fifth degree, and one count failure to provide address in the third degree.

In an effort to protect the identity of the alleged victim and the victim of Casey’s 2010 sexual battery case, to which Casey pleaded guilty, the Wilmington News Journal will not release information found in public records identifying the victims. Casey was in a position of trust to the alleged victim and the confirmed victim, both minors.

Casey waived his right to a speedy trial for all counts Oct. 14, said Clinton County Court of Common Pleas Judge John W. “Tim” Rudduck.

There will be one trial for the charge of receiving stolen property, which will be scheduled after the first trial for all other charges.

The first trial is scheduled for Jan. 5 and is expected to take five days.

The state made an offer to Casey before Thursday’s pre-trial, which Casey rejected.

The offer dropped eight of the charges against Casey, including two counts rape in the first degree, four counts sexual battery in the second degree, one count sexual battery in the third degree and one count unlawful sexual conduct with a minor in the second degree.

The deal included three counts rape in the first degree, one count failure to provide address in the third degree and one count receiving stolen property in the fifth degree.

If Casey accepted the deal, he would have served 18 years in prison.

Rudduck placed a deadline for counter-offers for Dec. 18. If no counter offers are placed or accepted, jury summonses will go out.

Casey was formerly the police chief at Newtonsville in Clermont County and was formerly a police officer for the Harveysburg Police Department in Warren County.

Clinton County Children Services officials originally investigated Casey for potential child abuse. The case was investigated by Wilmington Police Department Det. Bob Wilson, according to WPD Chief Duane Weyand.

It was also investigated by Blanchester police, according to BPD Chief Scott Reinbolt. The investigation revealed that between Sept. 1, 2009 and Sept. 30, 2011, a girl, who would have been nine to 11 years old, was raped by someone she knew while in Blanchester, Reinbolt said.

The jury trial will start Jan. 5 at 9 a.m.
