Defense: Exclude DNA test in Warren Co. trial for man in 1992 slaying

LEBANON, Ohio (AP) — Defense lawyers are trying to have new DNA tests excluded from the trial of an Arizona man accused of shooting a competing Ohio furniture salesman to death in 1992.

The Dayton Daily News reports lawyers for Sam Perone say in their motion filed last month in Warren County that prosecutors used all the remaining samples. They say they can no longer conduct their own DNA tests.

Perone has pleaded not guilty to murder and denies involvement in Richard Woods’ death.

The body of the 41-year-old Dublin man was found with gunshot wounds to the head in a ravine near Perone’s Lebanon store. Blood was also found on a square of carpet in the store.

The trial is scheduled for June 20. Perone is jailed on $750,000 bond.
