2 sentenced on theft-related charges

WILMINGTON — The following report is compiled using a disposition report provided by Clinton County Municipal Court. The information includes the defendant’s name, age, residence if listed, charge(s) disposed, fine, court costs assessed, jail sentence and any special conditions. Municipal Judge Mike Daugherty oversees the court, which administers the law in criminal misdemeanor cases.

The following pled guilty or were found guilty of crimes between Oct. 17 and Oct. 24:

• Harry Armstrong III, 26, Washington Court House, receiving stolen property, sentenced to 180 days in jail, fined $500, assessed $125 court costs, must have no conduct with business, must commit no similar offenses for two years, and be monitored by non-reporting probation.

• Jordan Bart, 24, of Wilmington, three charges of theft, trespassing, driving under suspension, sentenced to 570 days in jail (390 days suspended), fined $700, assessed $625 court costs, an additional charge of theft was dismissed. Must perform 40 hours of community service, no contact with victims, must commit no similar offense for two years and write a letter of apology to victims, additional jail time suspended on the condition that the defendant commit no similar offenses for two years.

• Tosha Alexander, 32, of Wilmington, O.V.I., sentenced to 180 days in jail, fined $1,075, assessed $125 court costs, operator’s license suspended from June 11, 2016 to June 11, 2017. Alexander will attend supervised probation/substance abuse questionnaire/three-day resident driver intervention program, if compliant the court will suspend $375 of fine, limited driving privileges granted effected June 11, 2016, tags shall be impounded, ALS vacated.

• Jesse Tucker, 19, of Wilmington, two charges of driving under suspension, operating vehicle without a seat belt, driving under suspension-financially, drug paraphernalia, fined $330, assessed $375 court costs. First DUS charge amended from a misdemeanor 1, must pay fines only on seat belt charge, an additional DUS charge, traffic light violation charge, and a marijuana possession charge were dismissed.

• Griffin Wise, 33, of Sabina, resisting arrest, sentenced to 90 days in jail (63 days suspended), fined $250, assessed $125 court costs. Must write a letter of apology to the victim, commit no offense for one year, and be monitored by unsupervised probation. Additional charges of misconduct at an emergency and disorderly conduct were dismissed.

• Marc Kennedy, 46, Clarksville, disorderly conduct, sentenced to 10 days in jail (suspended), fined $250, assessed $125 court costs. The charge was amended from assault misdemeanor 1, must have no contact with the victim, must commit no offense for one year.

• George Huston, 43, of Martinsville, criminal mischief, sentenced to 60 days in jail (suspended), fined $200, assessed $125 court costs. The charge was amended from domestic violence misdemeanor 1, must make no conduct with the victim, must write a letter of apology to the victim, commit no similar offenses for two years, must take part in non-reporting probation.

• Jason Pack, 36, of Cincinnati/Clarksville, driving without consent, ACDA, possession of drug instrument, sentenced to 120 days in jail (75 days suspended), fined $675, assessed $375 court costs. Must perform supervised probation, if the court will suspend $375 of fine, and write a letter of apology to the victim, an additional charge of having an open container was dismissed.

• Jessica Foster, 26, of Blanchester, menacing, sentenced to 30 days in jail (suspended), fined $100, assessed $125 court costs. The charge was amended from aggravated menacing misdemeanor 1, must have no contact with the victim, and write a letter of apology, commit no similar offense for one year, and perform non-reporting probation.

• Shylynne McCarty, 21, of Hillsboro, possession of marijuana, fined $100, assessed $125 court costs.

• Brandon Pinkerton, 27, of New Vienna, disorderly conduct, fined $250, assessed $125 court costs. The charge was amended from failure to comply misdemeanor 1.

• Howard Johnson, Jr., 56, disorderly conduct, sentenced to 30 days in jail (29 suspended), assessed $125 court costs. Paid court costs only.

• Amanda Creamer, 41, of Sabina, driving under suspension, fined $100, assessed $125 court costs.

• David Harnish, 35, of Reesville, driving under suspension-financially, fined $100, assessed $125 court costs. A second charge of driving under suspension-financially and a charge of tag/sticker violation were dismissed.

• Tyler Sims, 33, driving under suspension, driving across railroad crossing with visible warning, fined $125, assessed $125 court costs. Pay fines on crossing charge only.

• Taylor Cooper, 25, resisting arrest, sentenced to 180 days in jail (114 days suspended), no fines or costs. Must commit no similar offenses for one year, additional charges of obstruction of business and marijuana possession were dismissed.

• Brian Applegate, 37, possession of drug abuse instrument, trespassing, sentenced to 32 days in jail, fined $125, assessed $125 court costs. Only pay fines for trespassing charge, and must commit no offense for one year.

• Austin Mezinger, 19, of Perrysburg, possession of drug paraphernalia, fined $30, assessed $125 court costs. The charge was amended from possession of marijuana misdemeanor.

• James South, 21, of Wilmington, disorderly conduct, fined $30, assessed $125 court costs. The charge was amended from possession of marijuana minor misdemeanor.

• John Howard, 27, of Sabina, domestic violence, sentenced to 45 days in jail, fined $1,000, assessed $125 court costs. Must write a letter of apology to the victim.

• Kristin Houser, 31, of Blanchester, possession of drug instrument, sentenced to 90 days in jail (suspended), fined $750, assessed $125 court costs. Must perform supervised probation if complaint court will suspend $375 of fine.

• Justin Conley, 36, of Sabina, possession of drug instrument, sentenced to 90 days in jail (49 days suspended), fined $750, assessed $125 court costs. Must perform supervised probation if complaint court will suspend $375 of fine.

• Todd Hedges, 42, of Wilmington, possession of drug instrument, driving under suspension, sentenced to 180 days in jail (suspended), fined $850, assessed $250 court costs.

• Trenton Hibbs, 18, of New Vienna, O.V.I., no operator’s license, sentenced to 30 days in jail, fined $600, assessed $250 court costs, operator’s license suspended from Oct. 20, 2016 to April 19, 2017. ALS vacated, limited driving granted effective Nov. 4, 2016. An additional charge of crossing yellow lane was dismissed.

• Mark Rutledge, 56, of Frankfort, driving 90 in a 70 mph speed zone, fined $105, assessed $125 court costs. The case was waived by the defendant.

• Jason Stovall, 39, of Xenia, possession of drugs, fined $100, assessed $125 court costs. The case was waived by the defendant.
