Man shuns probation, gets prison

WILMINGTON — After being convicted of fleeing the scene of a traffic stop, the offender did not check in with his probation officer for more than a year and now has received an 18-month prison term.

Edwin Antonio Daley, 27, of Bethel, was stopped by the highway patrol in June 2015 on Interstate 71 in Clinton County for alleged traffic violations. Initially, Daley did stop his vehicle, but after a trooper made contact with him he fled the scene, according to court papers.

“The defendant fled in the vehicle at speeds above 100 mph while driving recklessly. The defendant stopped the vehicle nine miles later and was subsequently arrested,” Trooper K.L. Prose stated in an affidavit.

After Daley pled guilty to failing to comply with an order or signal of a police officer, he originally was placed on community control sanctions for three years, which included a three-year suspension of his operator’s license.

Daley did not appear for any meeting with probation staff after his sentencing hearing. Fourteen months later, he was back in custody and retired Judge William B. McCracken gave him the year-and-a-half prison term, with credit for 92 days served in jail.

In an unrelated case, Austin J. Buckalew, 22, of Wilmington, received a one-year prison term for grand theft. He was granted 150 days credit for time spent in jail on the case.

In other recent Clinton County Common Pleas Court sentencings:

• Jamie L. Mountjoy, 32, of Wilmington, received a six-month jail term and must take part in the residential STAR Community Justice Center program. He was sentenced after being found guilty of failing to comply and of operating a vehicle under the influence (OVI), the latter charge a misdemeanor.

Mountjoy’s operator license is suspended for three years, and he must pay court costs and a $375 OVI fine. He received credit for 56 days served in jail on the case.

• Michele Lee Reynolds, 33, of Wilmington, received a suspended six-month jail term and was put on community controls for three years after she was found guilty of illegal use of food stamps.

She was ordered to pay $770 restitution to Job & Family Services, plus pay court costs. Reynolds was granted time credit for the 14 days she served in the county jail.

• Tim M. Homan, 45, of Alpha, Ohio, received a six-month jail term and was placed under community controls for a two-year period after being convicted of aggravated possession of drugs. He must take part in residential STAR Community Justice Center programming.

Homan was fined $5,000, and also must pay court costs. He was granted time credit of eight days spent in jail.

• Richard Lee Stewart, 36, of Wilmington, was placed on community controls for a two-year period and received a suspended six-month jail term for violating a protection order, a fifth-degree felony.

He must pay court costs. Stewart received credit for a day spent in jail.
