City ordered to provide items in Pitzer civil case

WILMINGTON — The City of Wilmington has been ordered to provide items in a civil case involving the investigation into the death of Casey L. Pitzer.

On Thursday in Clinton County Common Pleas Court, the city was ordered to provide the items requested by Greg Pitzer. The city will have until Aug. 31 to “file an affidavit of items” provided to Pitzer, according to court documents.

The order was made by sitting Judge Stephen Wolaver — Judge John “Tim” Rudduck recused himself from the case.

In February, Pitzer filed a civil suit against the city wanting to obtain public records related to the investigation of his daughter’s death in 2013.

In March 2013, the body of Casey L. Pitzer, 32, was discovered in a retention pond around SR 73 and US 22/SR3 about a week after she went missing. Her body was sent to the Miami Valley Crime Lab for an autopsy, and authorities determined the cause of death was drowning. In December 2021, a petition was started to reopen the Pitzer case. Greg Pitzer believes his daughter was murdered.

According to the filed suit, in 2013 Pitzer and his attorney at the time received “incomplete/partial records” from the city. The documents indicate that in 2013, Pitzer made “numerous requests and phone calls seeking answers about the lack of investigation and missing key biological evidence.”

In January of this year, the case was sent to the FBI to review.

The suit also indicates that previous requests were made in October to the city and Montgomery County for any documents and items related to the case. In the filing, Pitzer indicated he received “only a partial fulfillment of the records requested.”

He said in the suit he believes officials in Clinton and Montgomery counties have not been transparent.

He also states in the suit he received documents from Wilmington Police Chief Ron Fithen he believed to be false, or that Fithen didn’t provide the information he wanted — particularly security footage.
