Clinton County Probation Dept. staff to monitor man for possible relapse

WILMINGTON — A court has made a determination in a case where a Wilmington man had heroin with him when he went onto the grounds of a local detention facility on Christmas Day 2014.

Bradley O. Dana Smart, 35, was given a suspended six-month jail term, with credit granted for eight days spent in custody, as one of his community control sanctions. He was placed on community controls for two years under the supervision of the Clinton County Adult Probation Department.

Clinton County Common Pleas Judge John W. “Tim” Rudduck noted, in court papers, that Smart is “gainfully employed.” The judge also stated the defendant previously served a prison term, having completed STAR Community Justice Center programming and then violating community control.

In the resolution of the present case, there are 16 rules and conditions Smart has agreed to follow during the time of the supervision. Those include once a week, face-to-face contact with supervision staff.

Violating his community controls will make him subject to a possible 12-month term in a state prison, according to court papers.

In the sentencing entry, Rudduck indicates Smart plans to reside with family, but still should be monitored for both the Sober Living House in Cuba, Ohio, the You-Turn Recovery Drug Court, and possibly the STAR relapse program.

During the course of the legal proceedings in the case, the defendant did not show up as required for a particular court hearing.

In a 2012 Clinton County case, Smart was convicted of trafficking in heroin.

In an unrelated local felony sentence pronounced this month, Merady L. Smith, 48, of Louisville, Kentucky, was placed under community controls through the end of 2017 for forgery.

Among her community control sanctions is a suspended six-month term of jail (time credit given for three days served), and a $500 fine.

According to online court records, Smith was indicted in the forgery case in January 2009 and arrested in August 2016.

In a prior Clinton County case in 1998, Smith was convicted of theft.
