Municipal court sentences handed down

The following report is compiled using a disposition report provided by Clinton County Municipal Court. The information includes the defendant’s name, age, residence if listed, charge(s) disposed, fine, court costs assessed, jail sentence and any special conditions. Municipal Judge Mike Daugherty oversees the court, which administers the law in criminal misdemeanor cases.

The following list includes those who pled guilty or were found guilty between April 19, 2021 and April 23, 2021:

• Dylan Patrick, 26, of Harveysburg, O.V.I. sentenced to 180 days in jail (suspended), operator’s license suspended from April 20, 2021 to April 20, 2022, fined $1,075, assessed $135 court costs. Patrick must take part in reporting probation and complete a three-day residential driver intervention program. Operator’s license was destroyed. ALS vacated. Driving privileges granted effective May 5, 2021. Additional charges of O.V.I.-high test and failure to control, along with a seat belt violation were dismissed.

• Gary Creek, 56, of Wilmington, O.V.I., sentenced to 180 days in jail (suspended), operator’s license suspended from April 21, 2021 to April 21, 2022, fined $1,075, assessed $135 court costs. Creek must take part in reporting probation and complete a three-day residential driver intervention program. Driving privileges granted effective April 21, 2021. Operator’s license was destroyed. ALS vacated. An additional O.V.I. charge and an O.V.I.-suspension charge were dismissed.

• Andrew Lawwill, 21, of Wilmington, assault, sentenced to 60 days in jail, fined $500, assessed $135 court costs. Lawwill must have no contact with the victim.

• Julie Burns, 50, of Wilmington, reckless operation, sentenced to 60 days in jail (suspended), fined $500, assessed $135 court costs. The offense was amended from an O.V.I. charge. Burns must complete a three-day non-residential driver intervention program and two years of non-reporting probation. If compliant, the court will suspend $250 of the fine. ALS vacated.

• Joseph Funk, 26, of Wilmington, physical control of a vehicle while intoxicated, sentenced to 60 days in jail (suspended), fined $500, assessed $135 court costs. The offense was amended from an O.V.I. charge. Funk must complete a three-day non-residential driver intervention program. If compliant, the court will suspend $250 of the fine. ALS vacated. A turn signal violation and a seat belt violation were dismissed.
