Clinton County judge hands down sentences

The following report is compiled using a disposition report provided by Clinton County Municipal Court. The information includes the defendant’s name, age, residence if listed, charge(s) disposed, fine, court costs assessed, jail sentence and any special conditions. Municipal Judge Mike Daugherty oversees the court, which administers the law in criminal misdemeanor cases.

The following list includes those who pled guilty or were found guilty between April 26, 2021 and April 30, 2021:

• Harley Davis, 40, of Wilmington, physical control of a vehicle while intoxicated, sentenced to 90 days in jail (suspended), fined $500, assessed $135 court costs. The offense was amended from an O.V.I. charge. Davis must take part in reporting probation. If compliant, the court will suspend $250 of the fine. ALS vacated. Additional charges of criminal damages, marijuana possession, and O.V.I.-suspension were dismissed.

• John Croy, 51, of Waverly, physical control of a vehicle while intoxicated, sentenced to 60 days in jail (suspended), fined $500, assessed $135 court costs. The offense was amended from an O.V.I. charge. Croy must complete two years of non-reporting probation. If compliant, the court will suspend $250 of the fine. ALS vacated.

• Jorge Cardenas, 56, of Middleboro, physical control of a vehicle while intoxicated, sentenced to 60 days in jail (suspended), fined $1,000, assessed $135 court costs. The offense was amended from an O.V.I. charge. Cardenas must take part in non-reporting probation. ALS vacated. An O.V.I.-high test charge and a marked lanes violation were dismissed.

• Shylynn Flint, 20, of Blanchester, going 80 in a 55 mph speed zone, sentenced to three days in jail (suspended), operator’s license suspended from April 29, 2021 to May 10, 2021, fined $250, assessed $135 court costs. Flint must not commit any more moving violations for two years and non-reporting probation to be monitored.

• Mark Melleby, 36, of Wilmington, two counts of no operator’s license, marijuana possession, fictitious registration, fined $900, assessed $540 court cost. Additional charges of driving under suspension-failing to appear/pay fine, driving under suspension-failing to reinstate, registration violation were dismissed.

• John Ross II, 29, of Wilmington, domestic violence. Sentencing stayed. Ross must complete diversion, 20 weeks of a batterer intervention program, and must not consume alcohol/drugs of abuse while the matter is pending.
